States argue that \u200cfirms like Kalshi are operating without required state \u2060licenses, in violation of gaming laws, including bans on wagers by those under 21.<!-- HTML_TAG_END --><\/p>\n<p class=\"yf-1fy9kyt\"><!-- HTML_TAG_START -->Those states include New Jersey, which last year sent Kalshi a cease-and-desist letter stating that its listing of sports-related event contracts on its platform \u2060violated state gambling laws that prohibit betting on collegiate sports.<!-- HTML_TAG_END --><\/p>\n<p class=\"yf-1fy9kyt\"><!-- HTML_TAG_START -->Kalshi sued the state, arguing its event contracts qualify as &#8220;swaps,&#8221; a type of derivative contract, that under the Commodity Exchange Act can only be regulated by the CFTC, which had granted the company a license to operate a designated contract market (DCM).<!-- HTML_TAG_END --><\/p>\n<p class=\"yf-1fy9kyt\"><!-- HTML_TAG_START -->A lower-court \u200bjudge \u200bhad sided with New York-based Kalshi and issued a preliminary injunction, prompting New \u200bJersey to appeal. But a majority of the judges \u200con the 3rd Circuit panel concluded the Commodity Exchange Act likely preempted state law.<!-- HTML_TAG_END --><\/p>\n<p class=\"yf-1fy9kyt\"><!-- HTML_TAG_START -->&#8220;Kalshi&#8217;s sports-related event contracts are swaps traded on a CFTC-licensed DCM, so the CFTC has exclusive jurisdiction,&#8221; U.S. Circuit Judge David Porter wrote.<!-- HTML_TAG_END --><\/p>\n<p class=\"yf-1fy9kyt\"><!-- HTML_TAG_START -->The ruling was in line with the position advanced in other litigation by the CFTC under President Donald Trump&#8217;s administration. The regulator last week sued Arizona, Connecticut and Illinois to prevent them from pursuing what it called unlawful efforts to regulate prediction markets.<!-- HTML_TAG_END --><\/p>\n<p class=\"yf-1fy9kyt\"><!-- HTML_TAG_START -->&#8220;Congress gave the CFTC exclusive jurisdiction over trades on DCMs, and this decision affirms the goals of \u200cCongress,&#8221; CFTC spokesperson Brooke Nethercott said in a statement.<!-- HTML_TAG_END --><\/p>\n<\/p><\/div>\n<div style=\"display: none\" data-testid=\"read-more\">\n<p class=\"yf-1fy9kyt\"><!-- HTML_TAG_START -->U.S. Circuit Judge Jane Richards Roth \u200bdissented, saying Kalshi is facilitating gambling and that its &#8220;offerings were virtually indistinguishable from \u200bthe betting products available on online sportsbooks, such as DraftKings and \u200bFanDuel.&#8221;<!-- HTML_TAG_END --><\/p>\n<p class=\"yf-1fy9kyt\"><!-- HTML_TAG_START -->New Jersey Attorney General Jennifer Davenport in a statement said her office is evaluating its options, as the \u200cruling will allow &#8220;certain companies to offer sports gambling in \u200bour states without following the careful \u200bgaming rules that everyone else follows.&#8221;<!-- HTML_TAG_END --><\/p>\n<p class=\"yf-1fy9kyt\"><!-- HTML_TAG_START -->Her office could potentially ask the full 3rd Circuit to rehear the case.
