They warned that allowing ICE to access employer data would discourage reporting and weaken the unemployment insurance program.<\/p>\n<partner-banner util-module-path=\"elements\/partner\" fluid=\"\" bottom=\"\" lazy=\"\" class=\"spacer-large\" min-height=\"390\" outstream=\"\"\/>\n<p>Local federal attorneys representing ICE argued the department is legally required to hand over the data targeting businesses that tip-line reports put under suspicion of employing undocumented individuals. In court filings, they said the state&#8217;s refusal to comply amounts to a legally unsound disagreement with federal immigration policy.<\/p>\n<partner-inline util-module-path=\"elements\/partner\" class=\"spacer-large\" placement=\"native-article_link\" sizes=\"[[300, 250], [3, 3]]\" min-height=\"250\" fluid=\"\" outstream=\"\"\/>\n<p>The office of Delaware Attorney General Kathy Jennings, whose attorneys represented state labor officials, declined to comment on the ruling and whether it may be appealed. A spokesperson for Governor Matt Meyer as well as the Department of Labor did not respond to emails seeking comment.<\/p>\n<p><cta-atoms-container-inline util-module-path=\"elements\/cta\" class=\"spacer-large\"\/><\/p>\n<p>In a written statement, Delaware&#8217;s newly appointed U.S. Attorney Benjamin Wallace emphasized that state agencies have typically complied with federal subpoenas and that state officials didn&#8217;t in this situation because of political reasons.<\/p>\n<partner-inline util-module-path=\"elements\/partner\" placement=\"native-article_link\" sizes=\"[[300, 250], [3, 3]]\" min-height=\"250\" fluid=\"\" outstream=\"\"\/>\n<p>&#8220;We are gratified that the court recognized the simple truth at the core of this case: federal law applies to everyone, whether they are a state or private entity, and whether they agree or disagree with the federal government\u2019s policy priorities,&#8221; Wallace wrote.<\/p>\n<partner-banner util-module-path=\"elements\/partner\" fluid=\"\" bottom=\"\" lazy=\"\" class=\"spacer-large\" min-height=\"600\" outstream=\"\" momentum=\"\"\/>\n<p class=\"exclude-from-newsgate\"><strong>The arguments: <\/strong><a href=\"https:\/\/www.delawareonline.com\/story\/news\/local\/2026\/04\/01\/court-showdown-as-delaware-resists-ice-demand-for-employer-data\/89420231007\/\" data-type=\"link\" data-id=\"https:\/\/www.delawareonline.com\/story\/news\/local\/2026\/04\/01\/court-showdown-as-delaware-resists-ice-demand-for-employer-data\/89420231007\/\">Federal judge questions Delaware&#8217;s attempt to sidestep ICE subpoena<\/a><\/p>\n<p>The contested subpoena was the last in a series that went unanswered by state labor officials during the first quarter of 2025. The subpoenas themselves are not legally confidential. However, Connolly, the presiding judge, sealed the final subpoena \u2013 the one at issue in the case \u2013 after federal officials sued the state to force compliance.<\/p>\n<p>The state has produced redacted copies of some of the initial subpoenas to Delaware Online\/The News Journal via a Freedom of Information Act request.\u00a0Those early subpoenas targeted a Perdue facility in Seaford as well as a fencing company and a Mexican restaurant in northern New Castle County.\u00a0\u00a0<\/p>\n<p>The final subpoena seeks data on the employees of 15 state businesses for the final two quarters of 2024 and is the subject of the current court wrangling.
