The facts are different. Who makes the threat matters. What the threat says matters. But Blanche himself said during the news conference that the Comey charges carry a five-year statute of limitations.<\/p>\n<partner-inline util-module-path=\"elements\/partner\" placement=\"native-article_link\" sizes=\"[[300, 250], [3, 3]]\" min-height=\"250\" fluid=\"\" outstream=\"\"\/>\n<p>The &#8220;86 45&#8221; incident involving Whitmer&#8217;s <a href=\"https:\/\/www.detroitnews.com\/story\/news\/local\/michigan\/2020\/10\/18\/whitmer-asks-trump-cool-it-says-hes-inciting-domestic-terrorism\/3702262001\/\">TV appearance on NBC&#8217;s &#8220;Meet the Press&#8221;<\/a> took place more than five years ago in October 2020 when Trump was the 45th president.<\/p>\n<p>At that time in 2020, Trump&#8217;s campaign had argued that &#8220;86-ing&#8221; &#8220;can be shorthand for killing someone,&#8221; while Whitmer&#8217;s team countered that the campaign&#8217;s reaction was evidence that no one in\u00a0the Trump campaign had worked in the restaurant industry, where &#8220;86&#8221; is a way to denote\u00a0a menu item being out or a customer being ejected from a\u00a0restaurant.<\/p>\n<p>In a Tuesday social media post, the Michigan Republican Party&#8217;s official X account questioned whether the Department of Justice would investigate Whitmer.\u00a0The Michigan GOP account also posted that the department had left &#8220;open the possibility of investigating Michigan Gov. Gretchen Whitmer&#8221; \u2015 a post that has been shared nearly 2,000 times.<\/p>\n<partner-banner util-module-path=\"elements\/partner\" fluid=\"\" bottom=\"\" lazy=\"\" class=\"spacer-large\" min-height=\"600\" outstream=\"\" momentum=\"\"\/>\n<p>The Department of Justice declined to comment Wednesday beyond Blanche&#8217;s remarks. Gretchen Whitmer for an 8645 emblem she displayed during an October 2020 interview on &quot;Meet the Press.&quot; They would fail if filed, she said.\" orientation=\"vertical\" class=\"spacer-large\" util-module-path=\"elements\/media\"\/><\/p>\n<p>&#8220;Charges against Governor Whitmer would be even more baseless than the charges against James Comey because they are time-barred under the statute of limitations,&#8221; McQuade told The Detroit News.<\/p>\n<partner-banner util-module-path=\"elements\/partner\" fluid=\"\" bottom=\"\" lazy=\"\" class=\"spacer-large\" min-height=\"390\" outstream=\"\"\/><partner-inline util-module-path=\"elements\/partner\" class=\"spacer-large\" placement=\"native-article_link\" sizes=\"[[300, 250], [3, 3]]\" min-height=\"250\" fluid=\"\" outstream=\"\"\/>\n<p>&#8220;Even if they were not time-barred, charges would fail for the same reasons the charges against Comey will fail.&#8221;<\/p>\n<p>McQuade, who teaches at the University of Michigan Law School, said the &#8220;86&#8221; displays do not satisfy the legal test for a &#8220;true threat,&#8221; which the U.S. Supreme Court has defined as a serious expression conveying that the speaker means to commit an act of unlawful violence.<\/p>\n<p>Second, the &#8220;86&#8221; expressions are political speech protected by the First Amendment, &#8220;just as it protects President Trump&#8217;s statements\u00a0to &#8216;fight, fight, fight,&#8217; or that Gen. Mark Milley should be &#8216;executed,'&#8221; McQuade said by email.<\/p>\n<p>The former Detroit U.S. Attorney also said a prosecution for the &#8220;86&#8221; displays would likely be challenged as selective prosecution because others who have used or sold similar displays haven&#8217;t been charged.<\/p>\n<partner-banner util-module-path=\"elements\/partner\" fluid=\"\" bottom=\"\" lazy=\"\" class=\"spacer-large\" min-height=\"390\" outstream=\"\"\/>\n<p>&#8220;One need only perform a simple <a href=\"https:\/\/www.amazon.com\/s?k=8645&amp;i=fashion&amp;ref=nb_sb_noss_1\">search on Amazon<\/a> to see all manner of merchants selling T-shirts, hats, and bumper stickers stating &#8216;8647&#8217; as well as &#8216;8646&#8217; for that matter,&#8221; said McQuade, the latter a reference to former President Joe Biden, the 46th president.<\/p>\n<p>Troy criminal defense attorney Wade Fink of Wade Fink Law PC said any analysis of possible Whitmer charges must consider Trump\u2019s well-known desire to punish Comey for political reasons, viewing Comey as someone who \u201cweaponized\u201d the justice system against him.\u00a0<\/p>\n<p>\u201cFrom a legal standpoint, I would say the likelihood of obtaining a conviction for this charge is almost zero. The danger is this being not normal times, and this administration\u2019s willingness to stretch the law to a point that it\u2019s unrecognizable to the point that anyone that they don\u2019t like can be a target,\u201d Fink said.\u00a0<\/p>\n<partner-inline util-module-path=\"elements\/partner\" class=\"spacer-large\" placement=\"native-article_link\" sizes=\"[[300, 250], [3, 3]]\" min-height=\"250\" fluid=\"\" outstream=\"\"\/>\n<p>\u201cSo, depending on how the administration feels about our wonderful governor, that day will determine whether or not there will be any further actions, based on what I\u2019ve seen in other cases.\u201d<\/p>\n<partner-banner util-module-path=\"elements\/partner\" fluid=\"\" bottom=\"\" lazy=\"\" class=\"spacer-large\" min-height=\"390\" outstream=\"\"\/>\n<p>Fink, however, agreed that charges against Whitmer under the same law as Comey\u2019s would likely face statute of limitations problems, \u201cmeaning it probably can\u2019t be brought.\u201d<\/p>\n<p>Ted Goodman, spokesman for the Michigan Republican Party, contended the larger point was &#8220;Democrat politicians have played fast and loose with dangerous rhetoric.&#8221;<\/p>\n<p>&#8220;They&#8217;ve irresponsibly and wrongly painted President Trump as some sort of &#8216;existential threat,&#8217; which has led to real acts of violence and attempts on his life,'&#8221; Goodman said. &#8220;Gov. Whitmer knew exactly what she was doing with that 8645 symbol, and the fact that she displayed it during an interview just speaks to her arrogance \u2014 that she is above the law.&#8221;<\/p>\n<h2 class=\"presto-h2 wp-block-heading\">What Whitmer said during the October 2020 &#8216;Meet the Press&#8217; interview<\/h2>\n<p>During the 2020 interview on &#8220;Meet the Press,&#8221; Whitmer had criticized a Trump rally in Muskegon, where the crowd chanted\u00a0<a href=\"https:\/\/www.detroitnews.com\/story\/news\/local\/michigan\/2020\/10\/17\/president-trumps-return-michigan-draws-thousands-muskegon\/3677360001\/\" target=\"_blank\" rel=\"noreferrer noopener\">&#8220;lock her up&#8221;<\/a>\u00a0against Whitmer, roughly 10 days after state and federal officials announced they foiled a <a href=\"https:\/\/www.detroitnews.com\/story\/news\/local\/michigan\/2020\/10\/08\/feds-thwart-militia-plot-kidnap-michigan-gov-gretchen-whitmer\/5922301002\/\">kidnapping plot<\/a> against the governor.\u00a0Nine suspects ended up being convicted by a jury or taking plea deals in <a href=\"https:\/\/www.detroitnews.com\/story\/news\/local\/michigan\/2022\/10\/26\/jury-convicts-3-men-of-supporting-terrorists-in-whitmer-kidnap-plot\/69590174007\/\">state<\/a> and <a href=\"https:\/\/www.detroitnews.com\/story\/news\/local\/michigan\/2022\/08\/23\/michigan-whitmer-kidnapping-conspiracy-plot-barry-croft-adam-fox\/7865780001\/\">federal courts<\/a>, while five suspects were acquitted in federal and <a href=\"https:\/\/www.detroitnews.com\/story\/news\/local\/michigan\/2023\/09\/15\/jury-clears-3-men-in-the-last-trial-tied-to-the-plot-to-kidnap-michigan-gov-gretchen-whitmer\/70863273007\/\">state courts<\/a>.<\/p>\n<partner-banner util-module-path=\"elements\/partner\" fluid=\"\" bottom=\"\" lazy=\"\" class=\"spacer-large\" min-height=\"390\" outstream=\"\"\/>\n<p>In the interview, Whitmer also implored the GOP president and other officials to &#8220;bring\u00a0the heat down&#8221; and accused Trump\u00a0of\u00a0&#8220;inspiring and incentivizing and inciting this kind of domestic terrorism.&#8221;<\/p>\n<p>A then-spokesman for the Trump campaign said Whitmer\u2019s &#8220;rampant hypocrisy would be laughable if it were not so dangerous.&#8221;<\/p>\n<partner-inline util-module-path=\"elements\/partner\" class=\"spacer-large\" placement=\"native-article_link\" sizes=\"[[300, 250], [3, 3]]\" min-height=\"250\" fluid=\"\" outstream=\"\"\/>\n<p>&#8220;Her constant partisan rhetoric on cable news drives violence towards President Trump and the first family. It must stop,&#8221; said Chris Gustafson, then a spokesman for the Trump campaign, in 2020.<\/p>\n<p>Trump&#8217;s response was evidence that &#8220;silly season is officially here,&#8221; Whitmer campaign spokesman Bobby Leddy said in 2020.<\/p>\n<partner-banner util-module-path=\"elements\/partner\" fluid=\"\" bottom=\"\" lazy=\"\" class=\"spacer-large\" min-height=\"390\" outstream=\"\"\/>\n<p>Whitmer and Trump often clashed during the COVID-19 pandemic. The governor called on his administration to take more drastic steps to limit the virus\u2019 spread and to make more equipment available to states, like Michigan.
