Authorities ruled her death an accident and said there was no evidence of foul play.<\/p>\n<p class=\"text | article-text\">The girl\u2019s father, Daniel Rodni, and grandfather, David Robertson, sued Upchurch in federal court in Nashville in 2023, claiming he defamed them in a video titled \u201cZERO proof of Kiely Rodni situation being REAL.\u201d <\/p>\n<p class=\"text | article-text\">According to the lawsuit, Upchurch suggested the case was fake and part of a scam to raise money through GoFundMe.<\/p>\n<p class=\"text | article-text\"><b>Previous: <\/b><a href=\"https:\/\/www.wsmv.com\/2023\/09\/29\/nashville-youtuber-sued-defamation-over-true-crime-video\/\" target=\"_blank\" rel=\"noreferrer\" title=\"https:\/\/www.wsmv.com\/2023\/09\/29\/nashville-youtuber-sued-defamation-over-true-crime-video\/\"><b>Nashville YouTuber sued for defamation over true crime video<\/b><\/a><\/p>\n<figure class=\"media-item | figure media-item-image article-image w-100\">\n<div class=\"figure-wrapper img-wrapper figure-img mb-0\"><a class=\"link | text-reset d-block h-100 w-100\" href=\"https:\/\/www.wsmv.com\/page\/our-apps\/\" rel=\"\" target=\"_self\"><\/a><\/div>\n<\/figure>\n<figure class=\"media-item | figure video | media-item-video pb-3 w-100\" data-video-asset=\"a7e09df7-3fa0-444a-a393-9a4867ba44fb\"\/>\n<p class=\"text | article-text\">Attorneys for Rodni\u2019s family said the videos spread false claims during a time of intense grief and caused damage to the family\u2019s reputation and emotional distress.<\/p>\n<p class=\"text | article-text\">The case centered on the limits of online commentary in the true crime community and whether statements made in viral videos crossed the line from opinion into defamation.<\/p>\n<p class=\"text | article-text\">The jury\u2019s verdict awarded $17.5M against Upchurch.<\/p>\n<p class=\"text | article-text\">Upchurch\u2019s counsel released the following statement:<\/p>\n<aside class=\"pullquote | article-pullquote\">\n<blockquote class=\"blockquote | fst-italic bg-light p-4 border-start\">\n<p class=\"mb-2\">The freedom of speech is one of the most fundamental rights that is necessary for every free society, and that right is one that needs protecting now more than ever. While Mr. Upchurch is a staunch advocate for the United States Constitution and the rights that so many veterans fought and died for, Mr. Upchurch can be that advocate and also feel sympathy for a family in their time of grief. It is in this spirit that Mr. Upchurch would like to extend his heartfelt sympathy to the Rodni, Robertson, and Nieman families.
