We have waited 30 years to the day,\u201d said Marlene Alejandre, who attended the indictment\u2019s announcement. Melisa Chantres, right, is his niece.<\/span><span class=\"caption__source\" data-testid=\"caption__source\">Erika Angulo \/ NBC News<\/span><\/figcaption><\/figure>\n<p id=\"anchor-95dee3\" class=\"body-graf\">The civilian planes Cuba shot down belonged to Brothers to the Rescue, a group founded in 1991 by Cuban American pilot Jos\u00e9 Basulto and other U.S.-based Cuban exiles who were strongly opposed to the Cuban government. Basulto has said he participated in the botched Bay of Pigs invasion in 1961, which was sponsored by the CIA with the aim of ousting Fidel Castro.<\/p>\n<p id=\"anchor-628063\" class=\"body-graf\">Brothers to the Rescue operated search-and-rescue flights over the Florida Straits. In the early 1990s, communist-run Cuba was in a deep economic crisis following the collapse of the Soviet Union, which had heavily subsidized it for decades. There were extreme shortages of food and medicine, and thousands of Cubans were taking to the seas in dangerous makeshift boats and rafts trying to reach the U.S.  <\/p>\n<p id=\"anchor-e65023\" class=\"body-graf\">In 1994, Cuba and the U.S. <a href=\"https:\/\/www.latimes.com\/archives\/la-xpm-1994-09-10-mn-36874-story.html\" target=\"_blank\">signed an immigration agreement<\/a>, and a subsequent \u201cwet foot, dry foot\u201d policy in 1995 sent Cubans back to the country if they were caught at sea, which helped stem the massive exodus. But Cubans still routinely tried to leave the country.<\/p>\n<p id=\"anchor-fb03e8\" class=\"body-graf\">Brothers to the Rescue routinely flew small planes over the waters trying to spot fellow Cubans so they could alert the U.S. Coast Guard to assist them. But it also sometimes penetrated Cuban airspace, <a href=\"https:\/\/nsarchive.gwu.edu\/briefing-book\/cuba\/2026-05-19\/cuba-declassified-records-brothers-rescue-shootdown\" target=\"_blank\">according to declassified U.S. records <\/a>that cite an official warning from the Federal Aviation Administration about the group\u2019s \u201ctaunting\u201d of the Cuban government. During their mission, <a href=\"https:\/\/www.nbcmiami.com\/news\/local\/4-men-killed-in-brothers-to-the-rescue-shoot-down-honored-on-25th-anniversary\/2390766\/\" target=\"_blank\">a Cuban MiG-29 shot down two of them<\/a> in <a href=\"https:\/\/cidh.oas.org\/annualrep\/99eng\/Merits\/Cuba11.589.htm#_ftn5\" target=\"_blank\">international airspace<\/a>.<\/p>\n<p id=\"anchor-e6c866\" class=\"body-graf\">Cuba <a href=\"https:\/\/x.com\/EmbaCubaUS\/status\/2056845893274333239\" target=\"_blank\">has said the planes were violating Cuban airspace<\/a>. Reports from the United Nations\u2019 International Civil Aviation Organization and the Inter-American Commission on Human Rights disagreed, concluding the Brothers to the Rescue planes were still in international airspace when they were shot down. <\/p>\n<p id=\"anchor-a83d79\" class=\"body-graf\">According to the U.N.\u2019s report, \u201c<a href=\"https:\/\/digitalrepository.unm.edu\/cgi\/viewcontent.cgi?article=13234&amp;context=notisur\" target=\"_blank\">Cuba acted without using standard interception procedures<\/a>\u201d when it shot down the planes, resulting in the deaths of Alejandre, Carlos Alberto Costa, Mario Manuel de la Pe\u00f1a and Pablo Morales. <\/p>\n<p id=\"anchor-3ac47d\" class=\"body-graf\">The men, according to the IACHR report, \u201c<a href=\"https:\/\/cidh.oas.org\/annualrep\/99eng\/Merits\/Cuba11.589.htm\" target=\"_blank\">died as a consequence of direct actions taken by agents of the Cuban State in international airspace<\/a>.\u201d<\/p>\n<p id=\"anchor-2a38ed\" class=\"body-graf\">In an interview with <a href=\"https:\/\/www.cnn.com\/US\/9603\/cuba_shootdown\/02_castro\/\" target=\"_blank\">Time magazine<\/a> in 1996, Fidel Castro said he ordered his military to shoot down planes violating Cuban airspace. <\/p>\n<p id=\"anchor-0b36db\" class=\"body-graf\">After the planes\u2019 downing, President Bill Clinton swiftly condemned Cuba\u2019s actions.  <\/p>\n<p id=\"anchor-e6b90a\" class=\"body-graf\">Instead of launching strikes on Cuban military bases, Clinton opted to support a bill to impose much tougher restrictions on Cuba. <\/p>\n<p id=\"anchor-c69c79\" class=\"body-graf\">\u201cIt wasn\u2019t gathering sponsors because it was considered too extreme and there wasn\u2019t any real interest in Congress in moving it along,\u201d said Ricardo Herrero, executive director of the Cuba Study Group, a nonpartisan group. \u201cAfter the shootdown, there was a huge public uproar, and Clinton felt he had to act.\u201d<\/p>\n<p id=\"anchor-c0fc85\" class=\"body-graf\">The House and the Senate passed the <a href=\"https:\/\/www.congress.gov\/bill\/104th-congress\/house-bill\/927\" target=\"_blank\">Cuban Liberty and Democratic Solidarity (LIBERTAD) Act<\/a>, also known as the Helms-Burton Act, and Clinton signed it into law. <\/p>\n<p id=\"anchor-1d9009\" class=\"body-graf\">The law has repercussions to this day, since it turned the sanctions into U.S. law. Now, only Congress can lift the restrictive embargo against Cuba and only if a series of conditions are met, including establishment of \u201ca transition government.\u201d<\/p>\n<p id=\"anchor-867b6b\" class=\"body-graf\">The Helms-Burton law also allowed the original owners of Cuban properties confiscated by Castro to sue the companies that are using them in U.S. courts. That part of the law had not been enforced until 2019 by President Donald Trump.<\/p>\n<p id=\"anchor-fe0647\" class=\"body-graf\">Some lawsuits have been <a href=\"https:\/\/www.miamiherald.com\/news\/nation-world\/world\/americas\/cuba\/article315738772.html\" target=\"_blank\">settled out of court<\/a> recently, including suits against the shipping companies Crowley Maritime and SeaBoard Marine.<\/p>\n<p id=\"anchor-143e1c\" class=\"body-graf\">Cuba\u2019s top leadership had not been indicted over the shootdown.  In 1998, five <a href=\"https:\/\/apnews.com\/general-news-52506cbe78cf471db57125c3910fffd7\" target=\"_blank\">Cuban intelligence agents<\/a> known as the \u201cCuban 5\u201d were arrested and convicted on charges including conspiracy and failing to register as foreign agents. She found out when a friend living in the U.S. called her. Morales told NBC News the period following the planes\u2019 shootings were torturous because she was harassed by pro-government mobs. It lasted until she and her daughter were able to come to the U.S. a few months later. <\/p>\n<p id=\"anchor-9a2492\" class=\"body-graf\">On Wednesday, they drove two hours from their Florida home to attend the event at Miami\u2019s Freedom Tower, where the indictments were announced.
