{"id":79297,"date":"2026-01-13T12:38:57","date_gmt":"2026-01-13T15:38:57","guid":{"rendered":"https:\/\/ubirataonline.com.br\/since-the-supreme-court-protected-transgender-people-from-discrimination-the-backlash-has-been-brutal\/"},"modified":"2026-01-13T12:38:57","modified_gmt":"2026-01-13T15:38:57","slug":"since-the-supreme-court-protected-transgender-people-from-discrimination-the-backlash-has-been-brutal","status":"publish","type":"post","link":"https:\/\/ubirataonline.com.br\/en\/since-the-supreme-court-protected-transgender-people-from-discrimination-the-backlash-has-been-brutal\/","title":{"rendered":"Since the Supreme Court protected transgender people from discrimination, \u2018The backlash has been brutal\u2019"},"content":{"rendered":"<p><br \/>\n<\/p>\n<div data-editable=\"content\" itemprop=\"articleBody\" data-reorderable=\"content\">\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk6zofmx002v26nn98s86852@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            When the Supreme Court, led by Justice Neil Gorsuch, ruled in 2020 that federal law protected transgender workers from discrimination, the justices appeared to launch a new era of rights for a historically shunned group.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p000063b6pkpsltk03@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            LGBTQ advocates believed the core principle of <a href=\"https:\/\/www.supremecourt.gov\/opinions\/24pdf\/23-477_2cp3.pdf\" target=\"_blank\">Bostock v. Clayton County<\/a> \u2013 that bias against transgender people amounts to unlawful sex discrimination \u2013 would extend beyond the workplace.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p000073b6pjg80okwq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Lower court judges, in fact, soon began relying on the Bostock decision to protect transgender individuals in educational settings, such as to ensure access to bathrooms of choice and desired sports teams. In 2021, the Biden administration cited Bostock as it imposed rules protecting trans individuals from discrimination in health care.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p000083b6puu691r4o@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            But the <a href=\"https:\/\/www.cnn.com\/2020\/07\/28\/politics\/neil-gorsuch-supreme-court-lgbtq-civil-rights-act-alito\">Bostock foundation was shaky at the Supreme Court<\/a>, as the majority grew more conservative. At the same time, Republican-controlled states increasingly adopted legislation diminishing transgender rights, in education and public facilities, healthcare and athletics.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p000093b6pxq2q9m1a@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cIt had great potential as a legal matter and, more broadly, as a political matter,\u201d said Georgetown law professor David Cole, \u201cin recognizing that when we discriminate against people because they are transgender we are, in fact, engaging in sex discrimination and enforcing sex-based stereotypes.\u201d\n    <\/p>\n<p>\n    <iframe loading=\"lazy\" frameborder=\"0\" height=\"200\" scrolling=\"no\" src=\"https:\/\/playlist.megaphone.fm?e=WMHY9511623054\" width=\"100%\"><\/iframe>\n<\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p0000a3b6pydeql6sl@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Cole, a former national legal director of the ACLU who argued on behalf of a transgender woman in the 2020 case, said Bostock\u2019s repercussions have cut in two directions.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p0000b3b6pvyakt5ep@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Bostock has provided coverage for trans individuals on the job. Yet, Cole, referring to the politicking and legislative efforts against trans rights, said, \u201cThe backlash has been brutal.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p0000c3b6paafhixkr@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Last June, the Supreme Court turned away from Bostock when it upheld state bans on hormone treatment and other medical care for trans youths. The 6-3 majority rejected arguments that they were a form of sex discrimination and declared the bans instead tied to age and medical use. Dissenting justices contended the new ruling, in <a href=\"https:\/\/www.supremecourt.gov\/opinions\/24pdf\/23-477_2cp3.pdf\" target=\"_blank\">United States v. Skrmetti<\/a>, simply could not be squared with Bostock.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p0000d3b6pk4gcuprw@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cAs was true in Bostock, then,\u201d they wrote, \u201cthe law deprives minors of medical treatment based, in part, on sex.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p0000e3b6p8r3ppwhj@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Now, in one of the most anticipated disputes of the justices\u2019 current session, the court will hear a pair of cases on Tuesday over whether states can keep trans women from participating on female sports teams without violating federal anti-bias statues or the Constitution\u2019s guarantee of equal protection of the law.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p0000f3b6phjdqqey5@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cBostock crystallized an understanding for the populus, both on rights and responsibilities under the law,\u201d said law professor Kara Ingelhart, director of the LGBTQI+ Rights Clinic at Northwestern. \u201cThen Skrmetti created confusion and a lot of mistrust.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p0000h3b6ppu6iule7@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The <a href=\"https:\/\/www.cnn.com\/2025\/06\/18\/politics\/supreme-court-transgender-gender-affirming-skrmetti-takeaways\">Skrmetti case revealed a shifting approach<\/a> and mindset at the court.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p0000i3b6pq7t5r0l9@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The opinion was written by Chief Justice John Roberts, who had been a vote for transgender rights in the 2020 case.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p0000j3b6pcuxbhpkc@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Joining the majority was also Gorsuch, Bostock\u2019s author. He had not asked a single question during the oral arguments, which was highly unusual, and then he wrote no separate opinion to explain how he was reconciling the two decisions.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p0000k3b6pgzux49v1@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Justice Amy Coney Barrett, who had joined the bench in late 2020 after Bostock, wrote separately in the 2025 case. Her approach would have directly undercut the potential reach of Bostock, rather than avoid the issue as Roberts\u2019 majority opinion had.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p0000l3b6p9oq2jo1a@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In her concurring statement, joined only by Justice Clarence Thomas (a Bostock dissenter), Barrett said she would have ruled that transgender individuals merit no heightened protection against discrimination. She also foreshadowed the upcoming debate over trans participation in sports.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p0000m3b6pxi34vnx7@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            If laws singling out transgender individuals require heightened judicial scrutiny, \u201cthen the courts will inevitably be in the business of closely scrutinizing\u201d a vast array of legislation,\u201d she wrote. \u201cBeyond the treatment of gender dysphoria, transgender status implicates several other areas of legitimate regulatory policy \u2013 ranging from access to restrooms to eligibility for boys\u2019 and girls\u2019 sports teams.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p0000n3b6po88gi2wp@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            During oral arguments in Skrmetti, Barrett questioned whether a pattern of government action against trans people existed: \u201c(At) least as far as I can think of, we don\u2019t have a history of de jure discrimination against transgender people, right? \u2026 Is there a history that I don\u2019t know about \u2026?\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p0000o3b6ppiwwno27@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Justice Sonia Sotomayor, who took the lead for the dissenters in last year\u2019s case, wrote, \u201cTransgender people have long been subject to discrimination in healthcare, employment, and housing, and to rampant harassment and physical violence.\u201d\n    <\/p>\n<div data-uri=\"cms.cnn.com\/_components\/image\/instances\/cmk7ffzkg00033b6p5upd2rqp@published\" class=\"image_large-elevate image_large__hide-placeholder\" data-image-variation=\"image_large\" data-name=\"PXL_20241204_193020062~2.jpg\" data-component-name=\"image\" data-observe-resizes=\"\" data-breakpoints=\"{\" image_large--eq-extra-small=\"\" data-original-ratio=\"0.5625\" data-original-height=\"1512\" data-original-width=\"2688\" data-url=\"https:\/\/media.cnn.com\/api\/v1\/images\/stellar\/prod\/pxl-20241204-193020062-2.jpg?c=original\" data-editable=\"settings\" data-article-gutter=\"true\">\n<div class=\"image_large__container\" data-image-variation=\"image_large\" data-breakpoints=\"{\" image_large--eq-extra-small=\"\">\n       <picture class=\"image_large__picture\"><source height=\"undefined\" width=\"679\" media=\"(max-width: 479px)\" srcset=\"https:\/\/media.cnn.com\/api\/v1\/images\/stellar\/prod\/pxl-20241204-193020062-2.jpg?c=original&amp;q=w_679,c_fill\/f_webp\" type=\"image\/webp\"><source height=\"undefined\" width=\"967\" media=\"(min-width: 480px) and (max-width: 767px)\" srcset=\"https:\/\/media.cnn.com\/api\/v1\/images\/stellar\/prod\/pxl-20241204-193020062-2.jpg?c=original&amp;q=w_967,c_fill\/f_webp\" type=\"image\/webp\"><source height=\"undefined\" width=\"860\" media=\"(min-width: 768px) and (max-width: 1023px)\" srcset=\"https:\/\/media.cnn.com\/api\/v1\/images\/stellar\/prod\/pxl-20241204-193020062-2.jpg?c=original&amp;q=w_860,c_fill\/f_webp\" type=\"image\/webp\"><source height=\"undefined\" width=\"860\" media=\"(min-width: 1024px) and (max-width: 1279px)\" srcset=\"https:\/\/media.cnn.com\/api\/v1\/images\/stellar\/prod\/pxl-20241204-193020062-2.jpg?c=original&amp;q=w_860,c_fill\/f_webp\" type=\"image\/webp\"><source height=\"undefined\" width=\"860\" media=\"(min-width: 1280px)\" srcset=\"https:\/\/media.cnn.com\/api\/v1\/images\/stellar\/prod\/pxl-20241204-193020062-2.jpg?c=original&amp;q=w_860,c_fill\/f_webp\" type=\"image\/webp\"><img decoding=\"async\" src=\"https:\/\/media.cnn.com\/api\/v1\/images\/stellar\/prod\/pxl-20241204-193020062-2.jpg?c=original&amp;q=w_860,c_fill\" alt=\"Chase Strangio, the first openly transgender lawyer to argue before the Supreme Court, speaks before the US Supreme Court on Wednesday, December 4, on US v. Skrmetti \u2014 a case that could determine whether states can ban this type of care for trans children and teens.\" class=\"image_large__dam-img image_large__dam-img--loading\" onload=\"this.classList.remove('image_large__dam-img--loading')\" onerror=\"imageLoadError(this)\" height=\"1512\" width=\"2688\" loading=\"lazy\"\/><\/source><\/source><\/source><\/source><\/source><\/picture>\n    <\/div>\n<\/div>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p0000p3b6p6k51wqi2@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            She added, with a reference to Barrett, that \u201cthose searching for more evidence of de jure discrimination against transgender individuals, need look no further than the present.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p0000q3b6pvcp0myjd@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The Trump administration, Sotomayor added, \u201chas started expelling transgender servicemembers from the military and threatening to withdraw funding from schools and nonprofits that espouse support for transgender individuals.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p0000r3b6pgtl6mj57@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            President Donald Trump, who campaigned against trans rights, <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/01\/defending-women-from-gender-ideology-extremism-and-restoring-biological-truth-to-the-federal-government\/\" target=\"_blank\">signed an executive order<\/a> on his first day back in the White House called, \u201cDefending Women from Gender Ideology Extremism and Restoring Biological Truth to the Federal Government.\u201d The order said, \u201cIt is the policy of the United States to recognize two sexes, male and female. These sexes are not changeable \u2026 .\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p0000s3b6p3j0df7ip@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In early challenges to Trump\u2019s policies targeting trans rights, the Supreme Court has sided with the president.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p0000t3b6ph63s65pv@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The conservative majority permitted the administration\u2019s new ban on trans people in the military and its elimination of a decades-old US passport option for trans travelers who would, rather than using their sex at birth, designate their gender identity as \u201cM,\u201d \u201cF,\u201d or \u201cX.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p0000u3b6p766w5ph6@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            In the latter case, the majority <a href=\"https:\/\/www.supremecourt.gov\/opinions\/25pdf\/25a319_i4dj.pdf\" target=\"_blank\">minimized an individual\u2019s interest in gender identity<\/a>, writing in an unsigned opinion, \u201cDisplaying passport holders\u2019 sex at birth no more offends equal protection principles than displaying their country of birth\u2014in both cases, the Government is merely attesting to a historical fact without subjecting anyone to differential treatment.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p0000w3b6p1zm48zx0@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The dispute to be heard Tuesday is likely to further show the limits of the Bostock ruling.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p0000x3b6pndp1xrgj@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Defending their bans on transgender women in female sports, state officials from Idaho and West Virginia argue schools should be able to separate athletes based on their biological sex. They say it is simply unfair and unsafe to let individuals who were born male compete with females.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p0000y3b6p877g1p7y@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The states, joined by the Trump administration, contend Bostock\u2019s principles were confined to the employment context covered by Title VII of the 1964 Civil Rights Act.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p0000z3b6po2u25pr3@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The 2020 Bostock case indeed centered on Title VII, yet such cases in the past have often extended to other realms of anti-discrimination policy and constitutional guarantee of equality. The third case began when a transgender woman (Aimee Stephens) lost her job.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p000113b6p6it0921a@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            At issue was whether Title VII\u2019s dictate that it is unlawful to fire an individual \u201cbecause of \u2026 sex,\u201d covered LBGTQ workers.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p000123b6pmqtvcpss@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Writing for the majority, the conservative Gorsuch said: \u201cAn employer who fires an individual for being homosexual or transgender fires that person for traits or actions it would not have questioned in members of a different sex. Sex plays a necessary and undisguisable role in the decision, exactly what Title VII forbids.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p000133b6pnegudyr7@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Gorsuch, Trump\u2019s first appointee to the high court, acknowledged that when the law passed in 1964, \u201cThose who adopted the Civil Rights Act might not have anticipated their work would lead to this particular result.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p000143b6p5cmfoubn@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            But, he said, Title VII\u2019s rule is \u201cstraightforward\u201d: \u201cAn employer violates Title VII when it intentionally fires an individual employee based in part on sex,\u201d and \u201cit is impossible to discriminate against a person for being homosexual or transgender without discriminating against that individual based on sex.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p000153b6paol21y3x@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Justice Samuel Alito, writing the lead dissent, disputed the majority\u2019s interpretation and said, \u201cWhat the Court has done today \u2013 interpreting discrimination because of \u2018sex\u2019 to encompass discrimination because of sexual orientation or gender identity \u2013 is virtually certain to have far-reaching consequences. Over 100 federal statutes prohibit discrimination because of sex.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p000163b6pq19n1ldj@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Alito warned that Bostock could also \u201cexert a gravitational pull in\u201d disputes brought under the Fourteenth Amendment\u2019s guarantee of equal protection. But that did not happen in last year\u2019s Skrmetti case.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p000173b6pox83iodi@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            Chief Justice Roberts said the laws prohibiting puberty blockers and hormone therapy for youths\u2019 transgender care involved age and medical treatment and did not turn on differences in sex. He said the court could avoid addressing whether Bostock\u2019s reasoning extends beyond the limits of the workplace and Title VII.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p000183b6pk0lr5cmu@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            \u201cThe problem with the majority\u2019s argument,\u201d Sotomayor wrote for liberal dissenters, \u201cis that the very \u2018medical purpose\u2019 (the law) prohibits is defined by reference to the patient\u2019s sex. Key to whether a minor may receive puberty blockers or hormones is whether the treatment facilitates the \u2018medical purpose\u2019 of helping the minor live or appear \u2018inconsistent with\u2019 the minor\u2019s sex.\u201d\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p000193b6pzu2ic16z@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The Idaho and West Virginia cases raise another set of nuanced dilemmas, in lawsuits brought by young transgender women seeking to compete on a college team and on a middle-school team.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p0001a3b6pr2wou9oa@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            The cases test whether state exclusions on trans women, now adopted in half the states, violate the Fourteenth Amendment or Title IX of the Education Amendment of 1972, which forbids sex discrimination in school programs that receive federal funding.\n    <\/p>\n<p class=\"paragraph-elevate inline-placeholder vossi-paragraph_elevate\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/cmk7el4p0001b3b6pxka95lka@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n            As was evident in the Skrmetti case involving transgender minors, such controversies involving young people generate greater concern than those revolving around adults.
